Extraction
The long-awaited completion of the challenging path of collecting all permitting documents required for deposit development is the actual commencement of extraction. However, even at this stage there are certain conditions and obligations of subsoil users that must be fulfilled in order for mineral extraction to be predictable, stable, and profitable. Subsoil users bear significant responsibility for environmental sustainability, occupational safety, and compliance with legislation.
Let us consider the main obligations of subsoil users:
Compliance with legislation. Subsoil use activities must be carried out within the framework of laws and regulations governing mineral development. It is not sufficient to obtain all necessary permits and licenses before commencing operations; during extraction it is also necessary to carefully monitor the validity periods of permitting documentation (the special permit for subsoil use or the permit for special water use) and regularly renew or extend them. A repeated geological and economic evaluation is mandatory in the event of revision of requirements regarding the quantity or quality of minerals or changes in processing technology that lead to a decrease in explored reserves by more than 20% or an increase in their volume by more than 50%.
Environmental responsibility. During the development of mineral deposits, measures must be taken to minimize environmental damage by applying modern technologies and methods that promote biodiversity conservation, reduction of harmful emissions, and efficient use of resources. In accordance with the Law of Ukraine “On Environmental Impact Assessment”, the key document regulating the environmental consequences of planned activities is the environmental impact assessment conclusion, and the information contained therein is mandatory for implementation. If it becomes necessary to change the technological process or increase the enterprise capacity, the environmental impact assessment procedure must be repeated.
Occupational safety. Occupational safety of employees is the responsibility of the subsoil user. The company must create safe working conditions, conduct necessary safety training and instruction, and provide adequate protection against potential risks and hazards in accordance with the Occupational Safety Rules during open-pit mining of mineral deposits and the Law of Ukraine “On Occupational Safety”.
Social responsibility. Subsoil users must take into account the social aspects of mineral development. They should interact with local communities, participate in social programs and the development of local infrastructure, contribute to job creation, and support stability in the regions where they operate.
Innovation and sustainable use of resources. This may include the implementation of energy-efficient technologies, the use of secondary materials and recycling, as well as the development of alternative energy sources. These efforts are aimed at reducing negative environmental impact and preserving natural resources for future generations.
Responsible waste management. The obligations of subsoil users include responsibility for proper management of waste generated during mineral development. This involves ensuring appropriate collection, processing, and disposal of waste in strict compliance with the requirements of the Law of Ukraine “On Waste Management”.
Monitoring. Subsoil users must systematically monitor their mineral development activities. In the field of supervision over the quantity and quality of minerals, the organization of geological and mine surveying support plays a primary role, regulated by Articles 37, 38, and 53 of the Subsoil Code of Ukraine, Order No. 669 of the Ministry for Development of Economy, Trade and Agriculture of Ukraine dated 31.03.2021 “On Approval of the Rules for Performing Mine Surveying Works during the Development of Ore and Non-Ore Mineral Deposits”, and NPAOP 00.0–1.01–85 “Unified Rules for Subsoil Protection during the Development of Solid Mineral Deposits.” Mining enterprises must have a mine surveying service staffed with qualified specialists and equipped with professional instruments and tools for processing and reproducing geological and surveying documentation. However, for deposits developed by open-pit methods, mine surveying support may be provided by third-party business entities under an appropriate agreement.
Reporting. At the end of each year, the subsoil user is obliged to report on the balance of mineral reserves using Forms 5‑GR, 6‑GR, and 7‑GR (depending on the type of mineral), submit a report on the implementation of the work program, and approve the Mining Operations Plan or the Water Abstraction and Consumption Plan for the following year. The mining development plan must reflect realistic extraction plans. If during the year it becomes necessary to change the extraction site to another area, this may require adjustment of the development plan and coordination of such changes. It is important to comply with procedures and rules to avoid negative consequences that may arise in case of discrepancies between actual extraction and the approved plan.
Land reclamation of the deposit upon completion of its development. Land reclamation of the deposit is a direct obligation of a responsible subsoil user and an important stage after mineral extraction that enables restoration of disturbed natural environments.
Summarizing the above, it should be noted that fulfillment of the obligations of subsoil users not only contributes to the creation of a sustainable and environmentally responsible mineral development industry, but also helps ensure environmental protection, employee health, and favorable conditions for local communities. Taking social and environmental factors into account in subsoil use activities promotes sustainable development and reflects high standards of corporate responsibility.
Proper fulfillment of obligations also ensures public and partner trust, which is an important aspect of successful activity in this sector. Stakeholders monitor the environmental and social impact of mineral development; therefore, compliance with the obligations of subsoil users becomes a determining factor for a company’s reputation and success.
