Extrac­tion

The long-await­ed com­ple­tion of the chal­leng­ing path of col­lect­ing all per­mit­ting doc­u­ments required for deposit devel­op­ment is the actu­al com­mence­ment of extrac­tion. How­ev­er, even at this stage there are cer­tain con­di­tions and oblig­a­tions of sub­soil users that must be ful­filled in order for min­er­al extrac­tion to be pre­dictable, sta­ble, and prof­itable. Sub­soil users bear sig­nif­i­cant respon­si­bil­i­ty for envi­ron­men­tal sus­tain­abil­i­ty, occu­pa­tion­al safe­ty, and com­pli­ance with leg­is­la­tion.

Let us con­sid­er the main oblig­a­tions of sub­soil users:

Com­pli­ance with leg­is­la­tion. Sub­soil use activ­i­ties must be car­ried out with­in the frame­work of laws and reg­u­la­tions gov­ern­ing min­er­al devel­op­ment. It is not suf­fi­cient to obtain all nec­es­sary per­mits and licens­es before com­menc­ing oper­a­tions; dur­ing extrac­tion it is also nec­es­sary to care­ful­ly mon­i­tor the valid­i­ty peri­ods of per­mit­ting doc­u­men­ta­tion (the spe­cial per­mit for sub­soil use or the per­mit for spe­cial water use) and reg­u­lar­ly renew or extend them. A repeat­ed geo­log­i­cal and eco­nom­ic eval­u­a­tion is manda­to­ry in the event of revi­sion of require­ments regard­ing the quan­ti­ty or qual­i­ty of min­er­als or changes in pro­cess­ing tech­nol­o­gy that lead to a decrease in explored reserves by more than 20% or an increase in their vol­ume by more than 50%.

Envi­ron­men­tal respon­si­bil­i­ty. Dur­ing the devel­op­ment of min­er­al deposits, mea­sures must be tak­en to min­i­mize envi­ron­men­tal dam­age by apply­ing mod­ern tech­nolo­gies and meth­ods that pro­mote bio­di­ver­si­ty con­ser­va­tion, reduc­tion of harm­ful emis­sions, and effi­cient use of resources. In accor­dance with the Law of Ukraine “On Envi­ron­men­tal Impact Assess­ment”, the key doc­u­ment reg­u­lat­ing the envi­ron­men­tal con­se­quences of planned activ­i­ties is the envi­ron­men­tal impact assess­ment con­clu­sion, and the infor­ma­tion con­tained there­in is manda­to­ry for imple­men­ta­tion. If it becomes nec­es­sary to change the tech­no­log­i­cal process or increase the enter­prise capac­i­ty, the envi­ron­men­tal impact assess­ment pro­ce­dure must be repeat­ed.

Occu­pa­tion­al safe­ty. Occu­pa­tion­al safe­ty of employ­ees is the respon­si­bil­i­ty of the sub­soil user. The com­pa­ny must cre­ate safe work­ing con­di­tions, con­duct nec­es­sary safe­ty train­ing and instruc­tion, and pro­vide ade­quate pro­tec­tion against poten­tial risks and haz­ards in accor­dance with the Occu­pa­tion­al Safe­ty Rules dur­ing open-pit min­ing of min­er­al deposits and the Law of Ukraine “On Occu­pa­tion­al Safe­ty”.

Social respon­si­bil­i­ty. Sub­soil users must take into account the social aspects of min­er­al devel­op­ment. They should inter­act with local com­mu­ni­ties, par­tic­i­pate in social pro­grams and the devel­op­ment of local infra­struc­ture, con­tribute to job cre­ation, and sup­port sta­bil­i­ty in the regions where they oper­ate.

Inno­va­tion and sus­tain­able use of resources. This may include the imple­men­ta­tion of ener­gy-effi­cient tech­nolo­gies, the use of sec­ondary mate­ri­als and recy­cling, as well as the devel­op­ment of alter­na­tive ener­gy sources. These efforts are aimed at reduc­ing neg­a­tive envi­ron­men­tal impact and pre­serv­ing nat­ur­al resources for future gen­er­a­tions.

Respon­si­ble waste man­age­ment. The oblig­a­tions of sub­soil users include respon­si­bil­i­ty for prop­er man­age­ment of waste gen­er­at­ed dur­ing min­er­al devel­op­ment. This involves ensur­ing appro­pri­ate col­lec­tion, pro­cess­ing, and dis­pos­al of waste in strict com­pli­ance with the require­ments of the Law of Ukraine “On Waste Man­age­ment”.

Mon­i­tor­ing. Sub­soil users must sys­tem­at­i­cal­ly mon­i­tor their min­er­al devel­op­ment activ­i­ties. In the field of super­vi­sion over the quan­ti­ty and qual­i­ty of min­er­als, the orga­ni­za­tion of geo­log­i­cal and mine sur­vey­ing sup­port plays a pri­ma­ry role, reg­u­lat­ed by Arti­cles 37, 38, and 53 of the Sub­soil Code of Ukraine, Order No. 669 of the Min­istry for Devel­op­ment of Econ­o­my, Trade and Agri­cul­ture of Ukraine dat­ed 31.03.2021 “On Approval of the Rules for Per­form­ing Mine Sur­vey­ing Works dur­ing the Devel­op­ment of Ore and Non-Ore Min­er­al Deposits”, and NPAOP 00.0–1.01–85 “Uni­fied Rules for Sub­soil Pro­tec­tion dur­ing the Devel­op­ment of Sol­id Min­er­al Deposits.” Min­ing enter­pris­es must have a mine sur­vey­ing ser­vice staffed with qual­i­fied spe­cial­ists and equipped with pro­fes­sion­al instru­ments and tools for pro­cess­ing and repro­duc­ing geo­log­i­cal and sur­vey­ing doc­u­men­ta­tion. How­ev­er, for deposits devel­oped by open-pit meth­ods, mine sur­vey­ing sup­port may be pro­vid­ed by third-par­ty busi­ness enti­ties under an appro­pri­ate agree­ment.

Report­ing. At the end of each year, the sub­soil user is oblig­ed to report on the bal­ance of min­er­al reserves using Forms 5‑GR, 6‑GR, and 7‑GR (depend­ing on the type of min­er­al), sub­mit a report on the imple­men­ta­tion of the work pro­gram, and approve the Min­ing Oper­a­tions Plan or the Water Abstrac­tion and Con­sump­tion Plan for the fol­low­ing year. The min­ing devel­op­ment plan must reflect real­is­tic extrac­tion plans. If dur­ing the year it becomes nec­es­sary to change the extrac­tion site to anoth­er area, this may require adjust­ment of the devel­op­ment plan and coor­di­na­tion of such changes. It is impor­tant to com­ply with pro­ce­dures and rules to avoid neg­a­tive con­se­quences that may arise in case of dis­crep­an­cies between actu­al extrac­tion and the approved plan.

Land recla­ma­tion of the deposit upon com­ple­tion of its devel­op­ment. Land recla­ma­tion of the deposit is a direct oblig­a­tion of a respon­si­ble sub­soil user and an impor­tant stage after min­er­al extrac­tion that enables restora­tion of dis­turbed nat­ur­al envi­ron­ments.

Sum­ma­riz­ing the above, it should be not­ed that ful­fill­ment of the oblig­a­tions of sub­soil users not only con­tributes to the cre­ation of a sus­tain­able and envi­ron­men­tal­ly respon­si­ble min­er­al devel­op­ment indus­try, but also helps ensure envi­ron­men­tal pro­tec­tion, employ­ee health, and favor­able con­di­tions for local com­mu­ni­ties. Tak­ing social and envi­ron­men­tal fac­tors into account in sub­soil use activ­i­ties pro­motes sus­tain­able devel­op­ment and reflects high stan­dards of cor­po­rate respon­si­bil­i­ty.

Prop­er ful­fill­ment of oblig­a­tions also ensures pub­lic and part­ner trust, which is an impor­tant aspect of suc­cess­ful activ­i­ty in this sec­tor. Stake­hold­ers mon­i­tor the envi­ron­men­tal and social impact of min­er­al devel­op­ment; there­fore, com­pli­ance with the oblig­a­tions of sub­soil users becomes a deter­min­ing fac­tor for a company’s rep­u­ta­tion and suc­cess.

Con­sid­er­ing the impor­tance of min­er­al devel­op­ment for soci­ety, the envi­ron­ment, and the econ­o­my, ful­fill­ment of oblig­a­tions by sub­soil users becomes an inte­gral part of sus­tain­able devel­op­ment and ensures a bal­ance between eco­nom­ic and social needs and envi­ron­men­tal require­ments.
