Land allo­ca­tion project for extract­ing min­er­als

The allo­ca­tion of land for min­er­al extrac­tion is a com­plex and impor­tant process that requires com­pli­ance with spe­cif­ic legal norms and pro­ce­dures. First and fore­most, it is nec­es­sary to obtain per­mis­sion for the devel­op­ment of a land allo­ca­tion project for the des­ig­nat­ed land plot. To do this, an appli­ca­tion must be sub­mit­ted to the respec­tive local Unit­ed Ter­ri­to­r­i­al Com­mu­ni­ty (UTC) where the land plot is locat­ed.

The appli­ca­tion should include the fol­low­ing doc­u­ments:
Graph­ic mate­ri­als demon­strat­ing the loca­tion of the land allo­ca­tion.
Copies of the pass­port and iden­ti­fi­ca­tion code of the appli­cant.
After sub­mit­ting the appli­ca­tion, the local coun­cil of the UTC is oblig­at­ed to review the appli­ca­tion with­in one month and make a deci­sion regard­ing grant­i­ng per­mis­sion for the devel­op­ment of the land allo­ca­tion project or refus­ing to grant such per­mis­sion.

After obtain­ing the deci­sion grant­i­ng per­mis­sion to devel­op the land allo­ca­tion project, you need to con­tact the rel­e­vant land man­age­ment orga­ni­za­tion to pre­pare the land sur­vey­ing project. This is done through fruit­ful coop­er­a­tion between gov­ern­ment author­i­ties, local self-gov­ern­ment bod­ies, the design orga­ni­za­tion, the future landown­er, and com­pli­ance with all leg­isla­tive and reg­u­la­to­ry require­ments.

The land allo­ca­tion project is an essen­tial com­po­nent of ter­ri­to­ry devel­op­ment and the ratio­nal use of land resources. The plan­ning process begins with study­ing the ter­ri­to­ry and its nat­ur­al char­ac­ter­is­tics, as well as con­sid­er­ing infra­struc­ture require­ments and the local pop­u­la­tion. An expert team con­ducts research on soil, hydrol­o­gy, topog­ra­phy, and oth­er fac­tors that influ­ence the selec­tion of opti­mal land plots for allo­ca­tion.

Next, the devel­op­ment of a land plot plan takes place, which includes deter­min­ing the bound­aries of the allo­ca­tion, locat­ing objects, estab­lish­ing land use require­ments, and cre­at­ing nec­es­sary infra­struc­ture. The result of this stage is a detailed cadas­tral plan of the land plot, that takes into account all fac­tors and require­ments relat­ed to land use. The final stage involves prepar­ing an explana­to­ry mem­o­ran­dum and defin­i­tive­ly deter­min­ing the rights and oblig­a­tions of land use.

Accord­ing to Arti­cle 50 of the Ukrain­ian Law “On Land Man­age­ment,” a land allo­ca­tion project must include the fol­low­ing ele­ments:
Explana­to­ry mem­o­ran­dum.
Geo­det­ic mate­ri­als of land man­age­ment design.
Cal­cu­la­tions of loss­es in forestry pro­duc­tion and dam­ages to land users (if required by law).
List of restric­tions on land use.
Cadas­tral plan of the land plot.

The land man­age­ment project devel­oped by land sur­vey­ors, in accor­dance with the Ukrain­ian Land Code and the Law “On Land Man­age­ment,” requires approval from the fol­low­ing orga­ni­za­tions:
Local admin­is­tra­tion of the State Geo­cadas­tre.
Local depart­ment of archi­tec­ture and urban plan­ning.
Oth­er orga­ni­za­tions (forestry, water man­age­ment, cul­tur­al her­itage pro­tec­tion, ecol­o­gy, etc.) in spe­cif­ic indi­vid­ual cas­es.
To approve the land allo­ca­tion project, it is nec­es­sary to apply to the same local self-gov­ern­ment body (OTG) that grant­ed per­mis­sion for the devel­op­ment of the land man­age­ment project and obtain a deci­sion to approve the land man­age­ment project for land allo­ca­tion. After­ward, the sub­soil user must con­clude a lease or sale-pur­chase agree­ment for the land plot for min­er­al extrac­tion. This agree­ment final­ly deter­mines the rights and oblig­a­tions of the par­ties, con­di­tions of land use, and respon­si­bil­i­ty for envi­ron­men­tal con­se­quences.

It is impor­tant to know that after the imple­men­ta­tion of the Ukrain­ian Law “On the State Land Cadas­tre,” state acts on land own­er­ship are no longer issued. The process of reg­is­ter­ing own­er­ship rights to a land plot now con­sists of two stages:
Reg­is­tra­tion of the land plot itself in the State Land Cadas­tre..
Reg­is­tra­tion of the rights to the land plot in the State Reg­is­ter of Real Rights to Immov­able Prop­er­ty.

The reg­is­tra­tion of a land plot in the State Land Cadas­tre (SLC) is car­ried out by a land man­age­ment orga­ni­za­tion, which sub­mits the fol­low­ing doc­u­ments to the state cadas­tral reg­is­trar:
Appli­ca­tion.
Land man­age­ment project for land allo­ca­tion.
XML file — a spe­cial­ized exchange file.
After the reg­is­tra­tion of the land plot in the State Land Cadas­tre (SLC), the land plot is assigned a unique cadas­tral num­ber, and an extract from the cadas­tre is gen­er­at­ed. This extract will be one of the nec­es­sary doc­u­ments for reg­is­ter­ing own­er­ship rights.

To reg­is­ter own­er­ship rights, the fol­low­ing set of doc­u­ments needs to be sub­mit­ted:
Deci­sion of the ter­ri­to­r­i­al com­mu­ni­ty coun­cil approv­ing the land man­age­ment project.
Extract from the State Land Cadas­tre.
Copies of iden­ti­fi­ca­tion doc­u­ments (pass­port and iden­ti­fi­ca­tion code).
Doc­u­ment con­firm­ing pay­ment for reg­is­tra­tion ser­vices.
The reg­is­tra­tion is con­firmed by issu­ing an extract from the State Reg­is­ter of Real Rights to Immov­able Prop­er­ty, which serves as the pri­ma­ry doc­u­ment con­firm­ing the reg­is­tra­tion of own­er­ship rights to the land plot.

After obtain­ing all the nec­es­sary doc­u­ments for the land, the sub­soil user must imple­ment envi­ron­men­tal mea­sures spec­i­fied in the license for sub­soil use. These mea­sures include pro­tect­ing water resources, reg­u­lat­ing emis­sions and waste, recla­ma­tion, and restora­tion of nat­ur­al ecosys­tems after extrac­tion, aim­ing to pre­serve the envi­ron­ment and min­i­mize the impact of min­ing on it. Dur­ing the extrac­tion of min­er­als, the land user is oblig­at­ed to mon­i­tor the envi­ron­men­tal impact and ensure com­pli­ance with estab­lished stan­dards and require­ments. This allows for time­ly iden­ti­fi­ca­tion and res­o­lu­tion of issues relat­ed to the envi­ron­men­tal con­se­quences of extrac­tion.

There­fore, the reg­is­tra­tion of land plots for min­er­al extrac­tion requires atten­tion to envi­ron­men­tal, eco­nom­ic, and social aspects. This con­tributes to bal­anced devel­op­ment, ensures com­pli­ance with legal require­ments, and min­i­mizes impact on the sur­round­ing envi­ron­ment. Adher­ing to rules and pro­ce­dures in the reg­is­tra­tion of land plots is an impor­tant step in estab­lish­ing sus­tain­able and respon­si­ble activ­i­ties in the field of min­er­al extrac­tion.
