Mining Allotment Project
The Mining Allotment Project is an essential component of the mineral deposit development process. During the extraction of ore or other mineral resources, it is often necessary to manage and remove water from the deposit in order to ensure the safety, efficiency, and stability of mining operations.
Mining allotment is a part of the subsoil granted to an organization or enterprise for the industrial development of the mineral resources contained within it, as well as for the construction and operation of underground facilities not related to mineral extraction, including those located on the continental shelf and within the exclusive (marine) economic zone.
Mining allotments may be granted to enterprises, institutions, organizations, as well as to citizens of Ukraine or foreign nationals only upon the availability of a Special Permit for Subsoil Use and an approved project for the development of a mineral deposit or the construction of a mining facility or underground structure not related to mineral extraction.
For newly established enterprises engaged in mining activities, mining allotments must be formalized prior to the commencement of construction of a mining facility or underground structure not related to mineral extraction.
The provision of additional mining allotments to an existing one is formalized as a new allotment. Mineral resources located within the boundaries of a mining allotment must be used strictly in accordance with the intended purpose.
An enterprise intending to use worked-out mine workings or subsoil for the construction and operation of underground facilities not related to mineral extraction must obtain a mining allotment regardless of whether it already holds a mining allotment for deposit development.
The granting of a mining allotment for the construction of underground facilities in areas containing mineral resources, or in areas where mining activities were previously conducted, is carried out only upon obtaining the appropriate construction permit in accordance with the established procedure.
Formalization of mining allotments is a mandatory condition for the development of mining activities and ensures safety, efficiency, and compliance with legislative requirements in the mining sector.
The Mining Allotment Project is a document containing a detailed plan and specifications for the establishment or expansion of a mining allotment. It is developed to ensure the safety, efficiency, and sustainability of mining activities.
When granting mining allotments, issues are resolved related to the proper division of mineral deposits into separate allotments in order to prevent leaving less valuable or technically unsuitable parts of deposits outside the boundaries, to ensure compliance with safety requirements during mining and blasting operations, and to prevent hazards to people, property, and the environment.
To obtain a mining allotment for mineral deposit development, an application must be submitted to the territorial authority of the State Labour Service.
The application must be accompanied by the Mining Allotment Project, which consists of an explanatory note and graphic materials.
The project includes information on the purpose and justification for obtaining the mining allotment, general data on the territory, geographical and administrative location, water bodies and land plots, geological characteristics of the subsoil area, and substantiation of the boundaries and dimensions of the mining allotment with relevant calculations.
The granting of a mining allotment is formalized by an official act.
In accordance with amendments to Article 17 of the Subsoil Code of Ukraine, mining allotments are granted exclusively for mining facilities where mineral deposits are developed by underground methods, namely through mines and shafts.
The Mining Allotment Project is a key stage prior to the implementation of mining activities. It ensures safety, efficiency, and sustainability of mineral extraction while taking into account environmental, technological, and economic aspects.
